In a decision filed today, the 6th Circuit Bankruptcy Appellate Panel (BAP) affirms that Chapter 7 bankruptcy is not available to someone who, when facing financial difficulties, refuses to change their lifestyle to stop traveling to Las Vegas and Atlantic City to play in poker tournaments.
This decision makes sense and is in line with the majority thinking in bankruptcy court that bankruptcy relief is available to the honest but unfortunate debtor.
The moral to this sad bankruptcy case seems to be: If you are asking for help from the bankruptcy court for relief from your creditors, you have to show that you have tried to help yourself first, and not continued the same lifestyle that you had before finances became tight.
